Pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) we inform that:

- Your personal data shall be processed:
- if you are a contractor of CAT Mosolf Polska sp. z o.o. – for the purpose of concluding and performing a contract to which you are a party; in such case, the legal basis for data processing is Article 6(1) (b) of the GDPR, or
- f you are an employee or co-worker of the contractor of CAT Mosolf Polska sp . z o.o. or a person authorised to represent the contractor of CAT Mosolf Polska sp . z o.o, and your data has been provided by your employer, principal or directly by you – in order to perform the contract concluded between CAT Mosolf Polska sp. z o.o. and your employer or principal; in such case, the legal basis for data processing is Article 6(1) (f) of the GDPR – while the performance of the aforementioned contract constitutes the legitimate interest of CAT Mosolf Polska sp. z o.o. as a data controller.
- Your personal data may also be processed on the basis of
- Article 6(1) (f) of the GDPR – which means that the processing is necessary for the purpose of the legitimate interests pursued by CAT Mosolf Polska sp. z o.o. or by a third party, such as direct marketing or the establishment, exercise or defence of legal claims arising from the performance of the contract concluded between CAT Mosolf Polska sp. z o.o. and the contractor,
- Article 6(1) (a) of the GDPR – if you have granted your consent to the processing of certain personal data, which concerns in particular sending commercial information by electronic means,
- Article 6(1) (c) of the GDPR – which means that processing is necessary for compliance with a legal obligation to which the Controller is subject, including archiving obligations regarding the documentation for tax purposes.
- CAT Mosolf Polska sp. z o.o. shall process ordinary personal data, including:
- in the case of contractors: name, surname, company name, business address, NIP (Tax Identification Number), REGON (Statistical Number), contact details (including email address, telephone number),
- in case of employees/co-workers of contractors and persons authorized to represent contractors: first name, surname, job position, data concerning the employer/principal, official contact details (email address, telephone number)
- CAT Mosolf Polska sp. z o.o. shall receive personal data directly from the data subjects. In the case of persons referred to in point 3 lit. b. above, their personal data may be provided by a contractor acting as an employer/principal of such persons.
- Providing of personal data is voluntary but necessary for the performance of the contract concluded between CAT Mosolf Polska sp. z o.o. and the contractor. The consequence of failing to provide data may be the inability to conclude and perform the aforementioned contract. In the case of data processed for marketing purposes, including in connection with sending commercial information by electronic means (if consent was granted), failure to provide data will result in the inability to receive such information.
- The recipients of your personal data may include in particular: entities from the capital group to which CAT Mosolf Polska sp. z o.o. belongs, e-mail hosting services provider, and other IT services providers, other contractors of CAT Mosolf Polska sp. z o.o., including subcontractors, senders and recipient of transport shipments and load who are not the direct customers of CAT Mosolf Polska sp. z o.o. and other entities from the transport/forwarding chain, entities providing auditing services, accountant services and other advisory services, including legal and tax services.
- Your personal data shall be processed by CAT Mosolf Polska sp. for the duration of the performance of the contract, and also afterwards, i.e. until the expiry of the limitation period for possible claims arising from the contract and in connection with the fulfilment of the 5-year archiving obligation concerning documents stored for tax purposes.
- You have the right to request access to your personal data, rectification of your personal data, erasure of your personal data, restriction of processing your personal data,
- If your personal data is processed under point 3 (a) or 4 (b) above, you also have the right to data portability, provided that the processing of personal data is carried out by automated means.
- If your personal data is processed under point 3 (b) or 4 (a) above, you also have the right to object to processing your personal data on grounds relating to your particular situation.
- If your personal data is processed under point 4(b) above, you also have the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out prior to your withdrawal.

- There shall be no automated decision-making, including profiling, as regards to your personal data
INFORMATION FOR SENDERS AND RECIPIENTS OF TRANSPORT SHIPMENTS AND LOADS WHO ARE NOT THE CUSTOMERS OF CAT MOSOLF POLSKA SP. Z O.O.

- Your personal data has been received by the Data Controller directly from you or has been provided by an entity that orders the Controller to provide a transport service for which you act in the supply chain as the sender or recipient of a shipment or loads
- The Controller receives the data necessary to provide the transport service, including: basic personal data (name, surname), company data (in the case of delivery for and/or on behalf of a business entity), contact data, address of the receipt/delivery and other data relating to the performed transport, including data relating to the concluded carriage/forwarding contract data necessary to complete the consignment note/CMR document.
- Your personal data shall be processed in accordance with Article 6(1) (f) of the GDPR – which means that processing is necessary for the purposes arising from the legitimate interests pursued by CAT Mosolf Polska sp. z o.o. or by a third party; the legitimate interests include the need to provide transport service,
- Your personal data may also be processed on the basis of
- Article 6(1) (f) of the GDPR – which means that the processing is necessary for the purpose of the legitimate interests pursued by CAT Mosolf Polska sp. . z o.o. or a third party, such as establishing, asserting or defending claims arising from the performance of a transport service, including the concluded carriage/forwarding contract,
- Article 6(1) (c) of the GDPR – which means that processing is necessary for compliance with a legal obligation to which the Controller is subject, including archiving obligations regarding the documentation for tax purposes.
- Providing your personal data is voluntary, but necessary to perform a transport service. Failure to provide personal data may hinder the performance of the service referred to in the preceding sentence.
- The recipients of your personal data may include in particular: entities from the capital group to which CAT Mosolf Polska sp. z o.o. belongs, e-mail hosting services provider and other IT services providers, entities providing auditing services, accountant services and other advisory services, including legal and tax services, as well as other contractors of CAT Mosolf Polska sp. z o.o., including subcontractors, in particular when providing such data is necessary to performance of the contract on other activities in the field of the business activity carried out by CAT Mosolf Polska sp. z o.o., and other entities from the transport/forwarding chain. z o.o. oraz inne podmioty z łańcucha przewozu/spedycji.
- Your personal data shall be processed by CAT Mosolf Polska sp. z o.o. for the duration of the performance of the transport/forwarding service and may also be processed later, i.e. until the expiry of the limitation period for any claims and in connection with the implementation of the 5-year archiving obligation regarding documents stored for tax purposes.
- You have the right to request access to your personal data, rectification of your personal data, erasure of your personal data, restriction of processing your personal data,
